Terms of Service

Welcome to BizCollab (the "Platform"). These Terms and Conditions govern your access to and use of our services. By registering an account or using the Platform, you agree to be bound by these terms.

  1. Parties and Eligibility

• The Provider: BizCollab (referred to as "we," "us," or "our"). • The Users: "Industry Leaders" (posting Hurdles) and "AI Specialists" (unlocking Hurdles). • Eligibility: You must be a registered business with a valid Australian Business Number (ABN) to use this Platform. By joining, you warrant that you are authorized to bind your business to these terms.

  1. The Nature of Our Service

BizCollab is a facilitator only. We provide a Hub for businesses to connect. We are not a party to any subsequent agreements, contracts, or work arrangements formed between an Industry Leader and an AI Specialist. We do not provide technical advice, nor do we guarantee the quality of work performed by any Specialist.

  1. Fees and Payments

• Hurdle Posting: It is currently free for Industry Leaders to post a Hurdle. • Unlock Fees: AI Specialists agree to pay a flat "Unlock Fee" (as displayed at the time of purchase) to access the contact details for a specific Hurdle. • Payments: All payments are processed via our secure third-party provider (e.g., Stripe). Fees are in AUD and include GST unless stated otherwise.

  1. User Obligations & Conduct • Accuracy: All Users must provide true, accurate, and current information. Industry Leaders must post genuine Hurdles and must not use the platform for general advertising. • Confidentiality: AI Specialists agree to use the contact information obtained through an "Unlock" solely for the purpose of responding to that specific Hurdle. • Prohibited Use: You may not use the Platform to scrape data, send unsolicited bulk communications (spam), or engage in misleading or deceptive conduct.

  2. Intellectual Property

We own all rights, title, and interest in the BizCollab platform, including our logo, design, and proprietary matching algorithms. You retain ownership of the content you post, but you grant us a non-exclusive license to display that content to other verified users for the purpose of the Hub.

  1. Australian Consumer Law (ACL) Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms is intended to exclude, restrict, or modify any non-excludable statutory rights you may have. For B2B transactions under $100,000, certain consumer guarantees regarding "fit for purpose" and "due care and skill" apply.

  2. Limitation of Liability To the maximum extent permitted by law, our total liability to you for any claim arising out of these terms is limited to the total fees paid by you to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential loss (such as loss of profit or data) resulting from your use of the Platform or your interactions with other Users.

  3. Dispute Resolution If a dispute arises:

  4. Negotiation: Parties must first attempt to resolve the issue through direct negotiation.

  5. Mediation: If unresolved after 14 days, the parties agree to participate in a formal mediation process in Victoria before commencing any legal proceedings.

  6. Termination We reserve the right to suspend or terminate your account if you breach these terms, fail our ABN verification process, or engage in conduct that we deem harmful to the BizCollab community.

  7. Governing Law These terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
