TACKL – TERMS OF SERVICE

Please read these Terms of Service carefully before using the Tackl platform.

  1. Interpretation and Definitions

1.1 Interpretation

Words with capitalised initial letters have the meanings defined below. These definitions apply whether the terms appear in the singular or plural.

1.2 Definitions

For the purposes of these Terms of Service: • Account means a user account created to access the Service. • Application means the Tackl software application provided by the Company. • Buyer means a User who purchases Goods via the Service. • Company, We, Us, or Our means Tackl. Ltd, a company registered in England and Wales. • Content means all text, images, listings, descriptions, messages, and other material uploaded or posted by Users. • Device means any device capable of accessing the Service. • Goods means used fishing tackle or related items listed on the Service. • Order means an agreement between a Buyer and Seller for the sale of Goods via the Service. • Seller means a User who lists Goods for sale. • Service means the Tackl website and/or Application. • Website means https://www.tackl.co.uk • User, You, or Your means any individual or legal entity using the Service.

  1. Acceptance of Terms

These Terms govern Your use of the Service and form a legally binding agreement between You and the Company.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You must not use the Service.

You confirm that You are at least 18 years old and legally capable of entering into binding contracts under UK law.

Use of the Service is also subject to our Privacy Policy, which complies with the UK GDPR and the Data Protection Act 2018.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms, except where consumer protection law provides otherwise.

Nothing in these Terms affects Your statutory rights as a UK consumer.

  1. User Accounts

5.1 Account Creation

You must provide accurate and up-to-date information. Providing false or misleading information is grounds for suspension or termination.

Usernames must not infringe third-party rights or be offensive or misleading.

5.2 Verification

We may require identity verification, payment details, or supporting documentation to comply with: • Anti-fraud measures • Payment processor requirements • Legal or regulatory obligations

5.3 No Endorsement

Tackl does not vet, endorse, or guarantee Users, Goods, or listings.

5.4 Account Security

You are responsible for safeguarding Your login credentials. Notify us immediately of unauthorised use.

5.5 Termination

We may suspend or terminate Accounts at our discretion for breaches of these Terms or suspected unlawful activity.

  1. User Content

6.1 Responsibility

You are solely responsible for the Content You upload and confirm that: • You own the Goods listed • Listings are accurate • Goods are lawful to sell in the UK

6.2 Licence

By uploading Content, You grant Tackl a non-exclusive, royalty-free licence to use and display it for operating the Service.

6.3 Prohibited Content

You must not upload Content that is: • Illegal or misleading • Counterfeit or stolen • Defamatory, abusive, or discriminatory • Infringing intellectual property rights

We may remove Content at our discretion.

  1. Marketplace Transactions

7.1 Platform Role

Tackl is a marketplace facilitator only. We are not a party to contracts between Buyers and Sellers.

7.2 Consumer Rights

Where Sellers qualify as traders under UK law, Buyers may have rights under: • Consumer Rights Act 2015 • Consumer Contracts Regulations 2013

Private sellers are not subject to the same obligations.

7.3 Payments

Payments are processed via third-party payment providers. We do not store card details.

7.4 Fees

Tackl may charge service fees, clearly displayed before checkout. Fees are non-refundable unless required by law.

7.5 Cancellations & Disputes

Disputes should be resolved between Buyer and Seller first. Tackl may assist but is not liable for outcomes.

  1. Liability and Disclaimers

8.1 Limitation of Liability

Nothing in these Terms limits liability for: • Death or personal injury caused by negligence • Fraud or fraudulent misrepresentation • Any liability that cannot be excluded under UK law

Subject to the above, Tackl’s total liability shall not exceed fees paid to Tackl in the previous 12 months.

8.2 No Warranty

The Service is provided “as is”. We do not guarantee uninterrupted or error-free operation.

  1. Third-Party Links

We are not responsible for third-party websites or services linked from the Service.

  1. Intellectual Property

All Tackl branding, software, and platform content (excluding User Content) belongs to Tackl Ltd and may not be used without permission.

  1. Feedback

Any feedback You provide may be used by Tackl without restriction or compensation.

  1. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in advance where required by law.

Continued use of the Service constitutes acceptance of the updated Terms.
